Equal pay: All provisions regulating the employment of workers apply to working women without discrimination, and all workers, male and female, are entitled to equal pay for work of equal value. This covers every form and element of pay — cash or in-kind benefits, raises, incentives, allowances, and others (art. 53).
General ban on discrimination: Any act, conduct, or measure that creates discrimination among persons in training, job advertising or hiring, terms and conditions of work, or the rights and duties arising from the contract is prohibited — whether based on religion, belief, sex, origin, race, color, language, disability, social status, political or union affiliation, geography, or any other ground that breaches equality and equal opportunity (art. 5).
Important note: A privilege or protection established for women, children, or persons with disabilities, to the extent necessary to achieve its purpose, is not prohibited discrimination (art. 5). Harassment, bullying, and any verbal, physical, or psychological violence against a worker are also prohibited (art. 4).
