Yes, you can withdraw from an apartment purchase by forfeiting your arboun deposit. The seller can also withdraw but must return double the deposit amount (art. 103).

Yes. As a rule, paying an arboun (deposit) at the time the contract is concluded means each party has the right to withdraw from it (art. 103). The deposit is treated as a sign that both sides reserved a right to back out, unless your contract expressly states otherwise.

The cost of withdrawing is clearly fixed:

  • If you withdraw (you paid the deposit), you forfeit the deposit (art. 103).
  • If the seller withdraws (he received the deposit), he must return double its value (art. 103).

This applies even if the withdrawal causes no harm at all (art. 103) — the other party need not prove any damage to keep the deposit or claim double it; the amount is the agreed penalty for backing out.

So check your contract first: if it expressly says the deposit is not a price for the right to withdraw, you cannot simply pull out by forfeiting it. If the contract is silent, the rule above applies.
